{"id":5946,"date":"2023-02-22T12:01:36","date_gmt":"2023-02-22T11:01:36","guid":{"rendered":"https:\/\/thomas-graser.at\/terms-and-conditions\/"},"modified":"2026-02-12T13:56:19","modified_gmt":"2026-02-12T12:56:19","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/thomas-graser.at\/en\/terms-and-conditions\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"\n<ol>\n<li><strong> Scope of Application<\/strong><\/li>\n<\/ol>\n<p>These General Terms and Conditions apply to all contracts between<br><strong>Thomas Graser, Altenheimstra\u00dfe 7, 2831 Scheiblingkirchen<\/strong>, Austria<br>(hereinafter referred to as the &#8220;Provider&#8221;)<br>and customers regarding the provision of services in the field of <strong>Human Energetics<\/strong> and the acquisition of <strong>digital content<\/strong> (e.g., meditations, energetic symbols, audio files, or PDFs).<\/p>\n<p>Services can be provided <strong>in person<\/strong> on-site, as <strong>remote healing<\/strong>, or online.<\/p>\n<ol start=\"2\">\n<li><strong> Human Energetics \u2013 Nature of the Services Offered<\/strong><\/li>\n<\/ol>\n<p>The services offered are provided within the scope of the liberal trade of <strong>Human Energetics<\/strong> in accordance with the guidelines of the Austrian Federal Economic Chamber (WKO).<\/p>\n<p>Human energetic applications are understood as <strong>holistic, energetic support<\/strong>, aimed at:<\/p>\n<ul>\n<li>harmonizing the energy system,<\/li>\n<li>supporting the perception of one&#8217;s own body,<\/li>\n<li>and promoting general well-being.<\/li>\n<\/ul>\n<p>The services offered are <strong>not medical, therapeutic, psychotherapeutic, or psychological treatments<\/strong>.<\/p>\n<p>There will be:<\/p>\n<ul>\n<li>no diagnoses made,<\/li>\n<li>no promises of healing given,<\/li>\n<li>no medical or therapeutic measures replaced,<\/li>\n<li>no medications recommended or prescribed.<\/li>\n<\/ul>\n<p>In case of health or psychological complaints, it is recommended to seek medical or therapeutic help.<\/p>\n<ol start=\"3\">\n<li><strong> Remote Energetic Applications<\/strong><\/li>\n<\/ol>\n<p>Remote energetic services are performed without physical contact and regardless of the customer&#8217;s location.<\/p>\n<p>The customer agrees that:<\/p>\n<ul>\n<li>the service takes place on an energetic level,<\/li>\n<li>perceptions and effects may be individual and subjective,<\/li>\n<li>no specific success is guaranteed.<\/li>\n<\/ul>\n<p>Remote healing also does not replace medical or psychotherapeutic care.<\/p>\n<ol start=\"4\">\n<li><strong> Conclusion of Contract<\/strong><\/li>\n<\/ol>\n<p>A contract is concluded by:<\/p>\n<ul>\n<li>the arrangement of an appointment (e.g., in person, by phone, email, or online booking),<\/li>\n<li>or by ordering digital content via the Provider&#8217;s website.<\/li>\n<\/ul>\n<p>By utilizing the service or purchasing a product, the customer agrees to these General Terms and Conditions.<\/p>\n<ol start=\"5\">\n<li><strong> Fees and Payment Terms<\/strong><\/li>\n<\/ol>\n<p>The currently valid prices can be found on the website or in individual agreements.<\/p>\n<p>All prices are in Euro.<\/p>\n<p>Unless otherwise agreed, the fee is:<\/p>\n<ul>\n<li>for individual sessions: <strong>during the session<\/strong>,<\/li>\n<li>for remote healing: <strong>before the start of the service<\/strong>,<\/li>\n<li>for digital content: <strong>before provision<\/strong><\/li>\n<\/ul>\n<p>due and payable via the offered payment methods.<\/p>\n<ol start=\"6\">\n<li><strong> Appointments and Cancellation<\/strong><\/li>\n<\/ol>\n<p>Agreed appointments are binding.<\/p>\n<p>Free cancellation of a personal treatment appointment is possible up to <strong>2 working days (Mon-Fri)<\/strong> before the agreed appointment. Please also note that Monday appointments cancelled on the preceding Friday will be charged, as our secretariat is not staffed on weekends. <\/p>\n<p>For later cancellations or no-shows, the treatment costs will be charged.<br>For remote healing appointments, there is <strong>NO<\/strong> refund after receipt of payment, because as soon as you are in contact with us and communicate your wish or need, something can already dissolve or noticeably change.<\/p>\n<ol start=\"7\">\n<li><strong> Digital Content (Meditations, Symbols, Audios, etc.)<\/strong><\/li>\n<\/ol>\n<p>The digital content offered serves for:<\/p>\n<ul>\n<li>relaxation,<\/li>\n<li>self-reflection,<\/li>\n<li>energetic support in daily life.<\/li>\n<\/ul>\n<p>They do <strong>not constitute medical, therapeutic, or psychological treatment<\/strong> and do not replace professional advice.<\/p>\n<p>Use is at your own risk.<\/p>\n<p>All content is protected by copyright. Any transfer, reproduction, or use beyond private use is not permitted without prior written consent from the Provider. <\/p>\n<ol start=\"8\">\n<li><strong>Personal Responsibility<\/strong><\/li>\n<\/ol>\n<p>The use of the services offered is at the customer&#8217;s <strong>own responsibility<\/strong>.<\/p>\n<p>It is confirmed that:<\/p>\n<ul>\n<li>energetic services do not replace medical or psychotherapeutic treatment,<\/li>\n<li>health decisions are made independently,<\/li>\n<li>existing medical or therapeutic treatments are not unilaterally discontinued.<\/li>\n<\/ul>\n<ol start=\"9\">\n<li><strong>Liability<\/strong><\/li>\n<\/ol>\n<p>The Provider is liable for damages only in cases of <strong>intent or gross negligence<\/strong>.<\/p>\n<p>Liability for:<\/p>\n<ul>\n<li>the absence of subjectively expected effects,<\/li>\n<li>personal development processes,<\/li>\n<li>decisions made based on energetic support,<\/li>\n<\/ul>\n<p>is \u2013 to the extent permitted by law \u2013 excluded.<\/p>\n<ol start=\"10\">\n<li><strong>Data protection<\/strong><\/li>\n<\/ol>\n<p>The processing of personal data is carried out in accordance with the applicable data protection regulations (GDPR).<br>Further information can be found in the privacy policy on the website.<\/p>\n<ol start=\"11\">\n<li><strong>Final Provisions<\/strong><\/li>\n<\/ol>\n<p>Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.<\/p>\n<p>Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.<br>The statutory regulation shall replace the invalid provision.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Scope of Application These General Terms and Conditions apply to  [&#8230;]<\/p>\n","protected":false},"author":6,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"100-width.php","meta":{"rs_blank_template":"","rs_page_bg_color":"","slide_template_v7":"","footnotes":""},"class_list":["post-5946","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.2 -
